Comentario al capítulo III: El concepto deontológico del derecho y sus implicaciones en relación a una teoría del deber [Der deontologische Rechtsbegriff und seine pflichttheoretischen Implikationen]

En el presente trabajo, el autor analiza el capítulo III del libro de Christoph Horn titulado Nichtideale Normativität. Contra la posición negativa de Horn en relación a la posibilidad de fundamentar los derechos humanos a partir de la filosofia jurídica kantiana, se argumentará, siguiendo la línea de Otfried Höffe y recurriendo al pensamiento de Habermas, que por medio del derecho nativo a la libertad Kant sí fundamenta de manera suficiente la existencia de derechos humanos de primera generación.
